2. Scope

These Terms govern (i) your access to and use of i46.cz, (ii) the public information published on it, and (iii) any commercial enquiry made through it. Specific services we deliver under written contract (assessments, testing, certification documentation, dataset licensing, R&D collaboration) are subject to the terms of that contract; in case of conflict, the contract prevails over these Terms.

By using this website you confirm that you have read, understood, and accepted these Terms. If you do not accept them, please do not use the site.

3. Permitted use of the website

You may access and read this website for lawful, non-commercial reference. You may not:

  • copy, scrape, mirror, or systematically extract content for republication or training of machine-learning systems without our prior written consent;
  • reverse-engineer, probe, or attempt to compromise the integrity or availability of our infrastructure;
  • misrepresent the source or licensing of materials you obtain from us;
  • use the site to distribute malware, conduct unsolicited commercial communications, or in any way that violates Czech, EU, or applicable national law.

4. Intellectual property

All text, graphics, logos, source code, datasets, design systems, and trademarks displayed on this website are the property of i46 s.r.o. or its licensors and are protected by Czech Act No. 121/2000 Coll. (Copyright Act), Regulation (EU) 2017/1001 (EU Trade Mark), and applicable international treaties. You receive no licence to any of these materials except as expressly granted in writing.

Brief, attributed quotation for review or research is permitted under Section 31 of the Czech Copyright Act.

5. Commercial services

Services described on this site : including but not limited to the CRA Readiness Service (gap diagnostic and full certification dossier), WATCH46 (continuous CRA-compliance monitoring platform), DISK46 (automated full-disk encryption for IoT hardware), Training Data for AI-Based Cybersecurity, CELL46 (stand-alone 5G/LTE network), and the Pan-European 5G Living Lab : are offered subject to a separate written engagement contract. Web descriptions are indicative; binding scope, deliverables, timelines, fees, and warranties are set out in that contract.

6. Complimentary CRA-Ready Assessment

Where we offer a complimentary assessment, we provide it without charge as a goodwill, pre-sales engagement. The complimentary assessment:

  • delivers an indicative compliance-gap report based on documentation you provide;
  • does not constitute formal certification or legal advice;
  • is provided “as is”, with no warranty of any kind, express or implied;
  • does not transfer any intellectual-property rights to you in our methodology or templates.

You may decline to proceed with any further paid engagement.

7. Fees & payment

Unless otherwise agreed in writing, fees for paid services are stated exclusive of VAT and other applicable taxes. Invoices are payable within 14 days of issue by bank transfer to the account specified on the invoice. Late payment carries statutory default interest under Czech Government Regulation No. 351/2013 Coll.

8. Confidentiality

Information you supply in the course of an enquiry or engagement, and information we supply to you (including methodology, test results, and source code), is treated as confidential. Confidential information may be disclosed only on a need-to-know basis to employees, processors, and advisors bound by equivalent confidentiality. Confidentiality survives termination of any engagement for a period of 5 years, or longer where required by law (e.g. trade-secret protection, ESA / EU project requirements).

9. Warranties & disclaimers

We perform our services with professional care and the diligence of a specialist provider. Beyond what is expressly committed in a written contract, the website and its content are provided on an “as available” basis without warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant uninterrupted availability of the website.

Compliance assessments, certification documentation, and laboratory test results reflect the state of regulation and the test articles at the time of assessment. They do not relieve you of your independent obligation to monitor regulatory changes and operate your products safely and lawfully.

10. Limitation of liability

To the maximum extent permitted by Czech law:

  • we are not liable for indirect, consequential, special, incidental, or punitive damages, including lost profits, lost data, lost goodwill, or business interruption;
  • our aggregate liability for any claim arising out of or in connection with these Terms or the website shall not exceed €1,000;
  • our liability under a written engagement contract is governed by that contract, and where it sets a different cap, that cap prevails.

Nothing in these Terms limits our liability for damage caused intentionally or by gross negligence, for breach of statutory duties towards consumers, or for any other liability that cannot be limited under Czech law.

11. Information for consumers

If, exceptionally, you contract with us as a consumer within the meaning of Czech Act No. 89/2012 Coll. (Civil Code), you have additional rights:

  • Withdrawal : you may withdraw from a distance contract within 14 days of conclusion, without giving reasons, unless services have already been fully performed with your prior express consent (Section 1837(a) of the Civil Code).
  • Out-of-court dispute resolution : you may bring consumer disputes to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz), or use the EU online dispute-resolution platform at ec.europa.eu/consumers/odr.

The vast majority of our engagements are business-to-business and the consumer regime does not apply.

12. Privacy & cookies

Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.

13. Export controls

Some of our deliverables : particularly cryptographic primitives, QRNG-related materials, and security-research datasets : are dual-use items within the meaning of Regulation (EU) 2021/821. Where applicable, you agree to comply with all relevant EU and national export-control rules, and to refrain from re-exporting or transferring such items to embargoed destinations or sanctioned end-users without authorisation.

14. Term & termination

These Terms apply for the duration of your use of the website. We may suspend or terminate access for users who violate these Terms or applicable law. Sections that by their nature are intended to survive (in particular intellectual property, confidentiality, liability, and governing law) survive termination.

15. Changes

We may amend these Terms to reflect changes in law, our services, or our operations. The effective date at the top of this page is authoritative. Material changes are announced on the homepage at least 14 days in advance. Continued use of the site after the effective date constitutes acceptance.

16. Governing law & jurisdiction

These Terms are governed by the laws of the Czech Republic, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The courts of Prague have exclusive jurisdiction over any dispute, subject to the mandatory consumer-jurisdiction rules of Regulation (EU) 1215/2012 where applicable.
